All obligations that You contract with IKOKAI, or all rights that You may demand from IKOKAI, and in general, any relationship between IKOKAI and You, will be governed by these terms and conditions. These terms and conditions regulate the use of the Platform, the purchase of products and the provision of services within the Platform and related to it and any relationship that You may establish with IKOKAI.

The IKOKAI Platform uses various electronic payment solutions, which may be available at the time you read these Terms and Conditions. It is the responsibility of each user to implement security policies in the systems they use, and, where appropriate, to adhere to the use recommendations of the aforementioned service providers. IKOKAI is not responsible for the misuse that the user makes of these systems and services, nor for the attacks that the users, their data, or the service providers suffer from hackers, malware, ransomware, phishing, or other events that cause, or may cause, the loss, dissemination, sale or misuse of user data, nor for the monetary or moral losses, damages or losses that this implies. Any liability derived from, or related to, the use of payment systems and services will correspond solely to the user, and/or, where applicable, to the corresponding service provider, with the user being responsible for following the terms and conditions of said services, which can be consulted on their respective websites. It will be up to users to credit payments, in case of discrepancy.

IKOKAI does not assume any responsibility for the misuse of users' banking, payment or personal data, since said data is deposited with third parties. Orders placed through the Platform cannot be cancelled, there will be no right to cancellation or refund.

We reserve the right to reject any order that the user places with us. We may, at our discretion, limit or cancel quantities purchased per person or order. These restrictions may include orders placed under the same customer account, the same credit card, debit card or other payment method, and/or orders that use the same billing and/or shipping address.

IKOKAI reserves the right to cancel and refund any order suspected of fraud, even when the information and/or documentation requested to validate the identification of the cardholder has been provided and/or said order has been previously authorized by an IKOKAI representative.

In the event that we make a change or cancel an order, we will attempt to notify the user via email or telephone. We reserve the right to limit or prohibit orders that, in our judgment, appear to be placed by distributors or resellers.

You agree that by completing a transaction or purchase within our website, you are providing current, complete and accurate information. We are not responsible for incorrect purchases or shipments, resulting from errors made by the user when providing data such as shipping address, email, telephone number, credit card numbers, expiration dates or any other data that is requested.

1. Payments with international cards and currency conversion

In the event that the User makes the payment using a credit or debit card issued outside the United Mexican States, an additional charge equivalent to two percent (2%) may be applied to the total amount of the operation, derived from international processing costs.

Additionally, when the transaction involves currency conversion carried out by financial institutions, payment gateways or card issuing entities, an additional charge of up to zero point five percent (0.5%) may be applied to the amount of the operation, corresponding to costs associated with said conversion.

Such charges will be informed in a clear and detailed manner to the User before payment is confirmed, forming part of the total amount to be paid. By completing the transaction, the User expressly agrees to the application of the aforementioned charges.

Payments made with cards issued in Mexico and that do not involve currency conversionwill not be subject to the additional charges indicated in this clause.

• OPTIONAL TOOLS

On occasion, we may provide the user with access to third-party tools over which we have no control. The user acknowledges and accepts that our website uses third-party tools, without any guarantee, representation, conditions of any kind and without any endorsement. We will have no liability arising from or related to the use of third-party tools. Any use of such tools is at your own risk and discretion, and you should ensure that you are familiar with the terms provided by third parties.

We may offer new services and/or features through the website (including the release of new products, tools and resources) at any time, which shall also be subject to our TERMS OF SERVICE.

In no event shall IKOKAI, its directors, administrators, officers, employees, affiliates or suppliers be liable for any loss, claim, direct, indirect, incidental damage, loss of data, replacement costs, or any similar damages, whether in contract, tort (including negligence), strict liability or otherwise; or any other claim related to our products and services, including any errors or omissions in content, losses or damages of any kind incurred as a result of the use of our products and services.

• COMPENSATION

The user agrees to indemnify, defend and hold harmless IKOKAI, its directors, administrators, officers, employees, affiliates or suppliers from any claim or demand, including attorneys' fees, made by any third party, arising from your breach of the TERMS OF SERVICE, other policies, or due violation of any law.

• DIVISIBILITY

In the event that any provision of these TERMS OF SERVICE is determined to be void or unenforceable, it will apply to the fullest extent permitted by applicable law. Such determination shall not affect the validity and enforceability of the remaining terms and provisions.

• TERMINATION

These TERMS OF SERVICE are effective unless there is a suspension of the service by us, or the user does not accept the policies of our website, in which case they will not be able to use our services. If in our discretion, the user fails to comply with any term or provision, we may terminate the agreement and suspend the service without right of reply, at any time and without prior notice.

• COMPLETE AGREEMENT

Our failure to comply with any term or provision of the TERMS OF SERVICE will not constitute a termination of the terms for other users of our website.
